About Law Division
Law Division manages the whole of Treasury’s legislative program and the preparation of all Treasury portfolio laws. The Law Division works with policy areas across Treasury, as well as with the Australian Taxation Office (ATO), Australian Securities and Investments Commission (ASIC), Australian Prudential Regulation Authority (APRA) and the Australian Competition and Consumer Commission (ACCC) to design legislation to implement legislative new policy in major and dynamic areas of commercial law and regulation: including corporations and financial systems; tax and superannuation; competition and consumer law; and foreign investment.
Law Division advises policy-makers on legislative frameworks design and implementation, instructs the Office of Parliamentary Counsel (OPC), prepares explanatory materials and project manages the extensive program of legislative measures in the Treasury portfolio. It is also responsible for Treasury’s legal services and information law obligations and works closely with the Attorney-General’s Department (AGD) and Australian Government Solicitor (AGS).
About the Role
Law Division is looking for Legal Advisers to fill APS5 and APS6 roles in the division’s General Counsel’s Branch (GCB).
In the GCB roles you will have responsibility for providing and procuring legal advice on a range of significant and or politically sensitive matters of strategic importance to the Treasury, and instructing on litigation. You will be expected to contribute to the work of the Branch on Freedom of Information, Privacy, and advising on commercial and procurement matters. You may also be asked to contribute to practice management activities.
Applicants found suitable for these roles may also be considered for positions in a Law Design Branch within Law Division. Our Law Design Branches work with policy areas across the Treasury portfolio to design legislation to implement new policy in major and dynamic areas of commercial law and regulation: including corporations and financial systems; tax and superannuation; competition and consumer law; and foreign investment. This includes advising on legislative framework design and implementation, instructing the Office of Parliamentary Counsel, preparing explanatory materials and assisting with the project management of the portfolio’s extensive legislative program.
In these roles you will collaborate with people from across Treasury, other Government agencies and the community.
To be successful, candidates will:
- demonstrate they can provide authoritative legal advice under broad supervision in the areas of statutory interpretation, administrative law, commercial law, freedom of information or privacy law;
- have the ability to procure high quality legal services from external legal providers and instruct on litigation;
- possess excellent oral and written communication skills, including the ability to liaise within the Treasury and with other legal practitioners and government departments and agencies;
- support and engage with the team members to work collaboratively; and
- be open, accountable and of high integrity.
Desirable Qualifications / Experience
Entry in the Register of Practitioners of the High Court of Australia or the roll of barristers and solicitors of the Supreme Court of a State or Territory is required.
Familiarity with the Commonwealth legal environment is highly desirable.
Employees of the Treasury are required to be Australian citizens and must hold a current security clearance or successfully complete a clearance prior to commencement.
