About Foreign Investment Division

The Foreign Investment Division (the Division) is part of the Corporate and Foreign Investment Group. It is responsible for administering Australia’s foreign investment laws as outlined in the Foreign Acquisitions and Takeovers Act 1975 and providing advice to the Government on foreign investment policy. 

In administering the framework, the Division closely engages with counterparts across Commonwealth, State and Territory governments and has significant links into the private sector. It services the Foreign Investment Review Board (FIRB) which is a non‑statutory body that advises the Treasurer and Government on foreign investment matters.

The Division is administering temporary zero dollar thresholds announced in late March as part of the Government’s Covid-19 response as well as implementing major reforms to the foreign investment framework announced by the Government on 5 June 2020, with commencement scheduled for 1 January 2021.

The roles

Treasury is seeking to appoint a number of Managers in the Compliance Branch. In these roles, you will be responsible for standing up Treasury’s capability to effectively discharge the new compliance powers. This will include building the monitoring and investigations functions and establishing and operating the infringements and enforcement program. To be a strong contender for these roles you will hold tertiary qualifications in law or a related discipline and have demonstrated experience in delivery of regulatory risk, accounting, financial services, and compliance and enforcement activities in an economic regulatory agency.

Treasury is also seeking to appoint a number of Managers in the Performance and Assurance Branch to oversee a range of organisational initiatives to facilitate the transition to the new regulatory regime.  The Branch has a central role in coordinating the implementation of the reform agenda and you will be required to manage this complex process. You will also work across the Division to design and implement governance and quality assurance frameworks, a regulatory strategy, and continuous improvement frameworks. You will also oversee the Division’s reporting obligations.  You will hold relevant tertiary qualifications and ideally have a background in regulatory policy and corporate related functions in a regulatory agency.

Treasury is also seeking to engage a specialist Legal Adviser to advise on the application of the FATA and associated legislation. You will work across all areas of the Division, providing high quality legal advice to support consideration of foreign investment applications and compliance action. You must hold a law degree, be admitted as a lawyer, legal practitioner, barrister, solicitor or barrister and solicitor of the High Court or Supreme Court of an Australian State or Territory; and be eligible to hold and maintain a practising certificate in the jurisdiction in which you practice. You should have expertise in foreign investment or mergers and acquisitions or be able to build this expertise quickly.

All candidates must have strong communication and negotiation skills and be able to engage with a broad range of stakeholders at senior levels, including Ministers and members of the Foreign Investment Review Board.  You will be respected as a results-oriented leader with integrity, judgement and astute decision-making, complemented by an ability to nurture teams and contribute to organisational stewardship.

Applicants must be able to obtain or maintain an NV1/2 or higher clearance level.
